بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ
The Prophet ﷺ said: "Marriage is my Sunnah. Whoever does not follow my Sunnah is not of me." [Ibn Majah — authenticated]. And Allah said: "He has placed between you mawaddah and rahma." (Ar-Rum 30:21). Islamic marriage is an act of worship. It deserves to be done correctly.
Conditions for Nikah according to Sharia
- Ijab and Qabul — offer and acceptance. Nikah is a verbal (or written) contract between the two parties.
- Wali — the matrimonial guardian of the bride-to-be. The majority of schools of fiqh require it as a condition for validity.
- Two witnesses — two adult, Muslim, and sane men, or (according to some schools) one man and two women.
- Mahr — the obligatory gift given to the wife. There is no imposed minimum, but the Prophet ﷺ said: "The best marriage is the least expensive." [Ibn Majah].
- Absence of Shari'ah impediments — mahram, marrying a second wife if the first one doesn't know, etc.
The Role of the Imam
The imam is not obligatory for the validity of nikah according to most schools of fiqh. But his presence is highly recommended: it attests to the validity of the contract, gives a spiritual dimension to the ceremony, and can facilitate the establishment of Islamic documents.
Legal Aspect in France: Civil Marriage vs. Nikah
In France, only civil marriage has legal value. Nikah is a religious act recognized by the Muslim community but without legal effect under French law.
Recommendation: perform both — civil marriage at the town hall BEFORE or at the same time as the nikah. This protects the rights of the wife (inheritance, alimony, social assistance) and those of the children.
Warning: since 2006, an imam who performs a nikah before civil marriage faces criminal prosecution in France. The majority of serious imams now require proof of civil marriage.
